Dotcom won that one

Oh FBI and NZ Police, you still have to go by NZ law

The ruling today  http://www.scoop.co.nz/stories/HL1206/S00207/dotcom-warrant-judgment-text.htm

Interesting ....

Will the FBI have to return the cloned drives ? Or will they continue as if nothing had happened?

Re: Dotcom won that one

They have been told that taking the data outside of NZ was illegal and against the previous ruling.

The trouble now is that in NZ law, it could mean all the evidence is now null and void in a court case as it was obtained illegally so is not to be used.

Re: Dotcom won that one

Quads,

Agreed, but reading the decision you linked to, rapidly I admit, it sounded as if the NZ authorities had already sent the cloned disks to the FBI so while the NZ decision may stop the prosecution in New Zealand it may not stop the FBI from doing what it can do to make life unpleasant for Dotcom (that's a person?) and colleagues.

Hugh,

Would you imply that the FBI would engage in any activities which might be slightly less than totally legal? :smileylol:

Re: Dotcom won that one

See this morning a US judge is looking into whether law enforcement stopping everyone getting access to their data including the legit paid for accounts was illegal.

This cold be a big jumbled mess.

You would think law enforcement would make sure they dot the i's and cross the t's before going in guns blazing (so to speak)

I must watch out for developments ... the law of unintended consequences doesn't just apply to security software then?
