Hi cinek,
You have to use the product key of your current and valid NIS 2009 subscription. Did that fail? NIS 2010 should have picked up the key automatically, the removal tool does leave the product key information untouched, from what I remember, so that a later Norton product can still pick it up.

Where did you download the trial from?
How did you install it on top off or clean install?

I downloaded the downloader from the update center. As I said, I removed NIS 2009 with norton removal tool
here's the screen shot of what it is:

it opened like that straight after I installed it

How many times did you run the removal tool, cinek? It is recommended to run it 2-3 times.

Cinek,
I managed to fish out this thread for you, it's a poster who had the same problem when trying to activate NIS 2009:
http://community.norton.com/norton/board/message?b
Summary of thread: if you are unable to activate the product 3-4 times (after you click on "Activate" 3- 4 times in succession), it should lead you to a Symantec webpage where you can activate the product in a different way.
The very last resort is to contact Symantec Customer Support.
