I am pretty sure, you will not be able to reproduce "Smart Firewall issue with these steps :) I have already posted How to reproduce "Smart Firewall" issue or fix it. Please, have a look at it. It should be very straightforward. The major idea is to "prepare" your PC for that:
1. Uninstall your Norton product (I was trying on perfectly working Norton 360 v3.5.0.12, choose "Norton complete uninstall"), restart PC when required.
2. Run buDump, Norton Removal Tool, delete manually Norton and Norton Installer folders and N360BUOptions.ini in ProgramData folder. Restart PC again.
3. Set both Windows Defender and Windows Firewall On (make sure, you turned On state for each of 3 profiles: "Domain Profile", "Private Profile", and "Public Profile" in "Advanced Settings" > "Action" > "Properties").
4. Restart PC.
At this stage you created a correct PC configuration as it should be prior to any firewall-antivirus installation. Am I right?
Now, proceed with your installation of Norton 360 v3.5.012. Use the latest registration key to activate 14 days subscription. Enjoy "Smart Firewall" issue. By the way, check the state of Windows Defender and Windows Firewall state for all 3 profiles from "Advanced Settings".
Let me know, if you still can't reproduce it.

I am having the SAME issue! If I turn it to on my internet stops working and the only way to fix it is a restart.
Hopefully the issue gets fixed soon.

So I too followed the steps to fix the Smart Firewall always off issue to no avail.
But some background....
I had the previous release of the Norton 360 Beta (3.5.0.9) in which I could not activate it over the internet. I initially contacted chat support and then found this forum. I downloaded the Norton 360 Beta (3.5.0.12) version, uninstalled 3.5.0.9, rebooted installed 3.5.0.12. I had a Symantec Chat remote control session that was immediately open and working as they had me type my login password before I rebooted.
I was able to perforn the activation of 3.5.0.12 but then noticed that the Smart Firewall was off. Now the Symantec Tech support was watching all of this via the remote control chat session.
Tried to enable the Smart Firewall both via the Fix It button and the General Settings of the Manage Firewall page. When this didn't work, I tried to get to the forum again .... No web browser access at all.
I ran the Windows 7 diagnostics via the web browser ... is said the DNS was not responding. My 1st DNS address was my router.
I tried to open the browser page of my router and my local network print server via the IP address -> No Go
I tried disabling the 3 Symantec browser add-ons -> still no web access.
I uninstalled 3.5.0.12 and followed the following article: How to reproduce "Smart Firewall" issue or fix it.
After following the article, the Smart Firewall still will not enable. If I try to "Fix It" or turn it on, it kills the web browser being able to open web pages over the web or in a private network.
So I eventually went back into Symantec's Manage Firewall page, Turned on the Smart Firewall, click Apply (do not click Close as it will appear off if you go back into the settings again), Turned off the Smart Firewall, click Apply.
Now I am able to browse the Internet again.
In this state this is the following findings:
Smart Firewall is off (It cannot be enabled ... I think it has a problem with IE 8)
The Windows Firewall is enabled for all profiles (The Windows Firewall with Advanced Security page says that the settings are managed Norton 360.
Windows Defender is enabled
I have Microsoft Office 2007 Ultimate installed with all of its updates, 15 in total.
I have an update for Silverlight 2.0.40115.0
I have 5 Windows (OS) updates:

KB958559
KB970789
KB970858
KB969497
I hope this is helpful in diagnosing why the Smart Firewall cannot be enabled properly.

i reproduced the problem again.....
my steps:
1. Uninstall NIS 2009 (build 16.7.0.12). I used the complete uninstall option.
2. Restarted the computer as prompted by the uninstaller.
3. Ran the installer file normally. NIS installed successfully.
4. Smart Firewall is disabled!!!!

I've tried installing both with the Windows Defender and firewall off (for all profiles) and with them both on to no avail. If I try to enable the Smart Firewall, it kills web browsing.
I tried to partially enable the Smart Firewall and manually disable Intrusion and Browser Protection as well as the Advanced Settings. This all breaks. There is even one point when I get a message that the Smart Firewall fail to load.
No rest for the weary. I just bust a half day on this... gotta get to work and do some other stuff now.

The answer for me was to turn Windows Defender off. Then, I uninstalled NIS 2009.7. I deleted the key.txt file in order to successfully reinstall (avoids activation issues).
Upon the reinstall, the Smart Firewall was working properly
