My Windows 8.1 install is non uefi with 350MB for the System Reserved partition and 100GB for the OS.
I first made imaged the System Reserved partition and the Windows8.1 Partition in case the Macrium Reflect software did not work.
I then downloaded Macrium Reflect Free Version: 6.0.753 (21 July 2015) http://www.macrium.com/reflectfree.aspx
During the installation it walks you through the downloading of addition windows components to create the SRD.
After the installation I created an SRD.
I then restored a fresh copy of windows8.1 (no software installed) and performed the Windows10 update.
Once that was done I booted the Macrium Reflect Free SRD and imaged windows10 (System Reserved partition ,Windows10 Partition and the Recovery Partition).
For more information see

To check if it worked I recovered Windows8.1 and then Windows10.
So if you updated from windows8.1 to Windows10 and have activated the licence in SSR2013 this workaround using the Macrium Reflect Free SRD to image the OS may not be ideal but it works.
Hope SSR2013 is updated to image windows10 from the software and the SRD soon.
