Would part of the problem be, because 2009 is already out?
As we have the latest version released, it is better to upgrade to the 2009. It has so many advanced features.
Please remove via Add/Remove; if you have any probelms with Add-Remove, then use the N.R.T. for installing N.I.S. 2009.
Do you get an Error Message? If so, please provide this.

Chris516, the problem should NOT be due to 2009 being released. When you get the failure, please open up the failure items and try to provide some more information so that we can pin this down. You may also want to inspect the liveupdate.log file to see which items are failing.
The best bet, though, probably is to upgrade to the 2009 version as the others have indicated.
When I check for updates, it completes. The downloading of updates also completes. But when it tries to process the updates, it fails.

If you have a valid subscription for the 2008 version, I suggest you to upgrade your Norton product to the 2009 version. It is a free upgrade.
Before upgrading to the 2009 version, I suggest you to take a backup of your identity safe profile.
Then run Norton Removal Tool
After that, you can download and install the Norton Internet Security 2009 version from the link http://www.norton.com/nis09
You can activate the 2009 version using your 2008 product key. Before following these steps, please make sure that you have the product key with you.
